Average car accident settlement

The best national benchmark is what auto insurers pay on the average bodily injury liability claim: $28,278 in 2024, according to the Insurance Information Institute. Here is what that number means and why your claim may be very different.

The national numbers

Claim type (2024)Average paid
Bodily injury liability (injuries to others)$28,278
Property damage liability (others' cars and property)$6,770
Collision (your own car)$5,489
Comprehensive (theft, weather, animals)$2,306
Insurance Information Institute, from ISO data. In 2024, 0.80 bodily injury liability claims were filed per 100 insured vehicles.

Why averages mislead

  • They mix minor and catastrophic injuries. A few very large claims pull the average up, so the typical claim is smaller.
  • They are capped by policy limits. The insurer pays at most the policy limit, so serious injuries caused by minimum-limit drivers show up as limit payments.
  • They are per claim, not per accident. One crash with several injured people produces several claims.
  • They are before fees and liens. What the injured person keeps is lower.

Examples by injury

These run typical numbers through the multiplier method the calculator uses, before fault, policy limits and fees. They are illustrations, not reported settlements.

InjuryMedicalLost wagesMultiplierClaim value
Whiplash, 8 weeks of therapy$4,500$1,2001.75$13,575
Broken wrist, cast and therapy$15,000$6,0003$66,000
Herniated disc with surgery$70,000$30,0004$380,000

What raises or lowers a settlement

  • Up: surgery, fractures, permanent impairment or scarring; long time off work; clear fault by the other driver, especially drunk or reckless driving; consistent treatment; higher policy limits.
  • Down: gaps in treatment, preexisting conditions, low property damage, shared fault under your state's comparative negligence rule, a no-fault threshold you do not meet, and minimum policy limits.

The cost of crashes

The National Highway Traffic Safety Administration estimated the economic cost of U.S. motor vehicle crashes in 2019 at $340 billion, and the comprehensive cost including lost quality of life at $1.37 trillion. Those totals include medical care, lost productivity, property damage and congestion, most of which never becomes an insurance claim.

Frequently asked questions

What is the average car accident settlement?

The closest national benchmark is the average bodily injury liability claim paid by auto insurers, which the Insurance Information Institute reports as $28,278 in 2024. The average property damage liability claim was $6,770. Your claim can be far above or below that, depending mainly on your medical treatment and the insurance available.

What is the average settlement for a rear-end collision?

There is no official average by crash type. Rear-end crashes often involve neck and back injuries, and the value follows the same drivers as any claim: medical bills, time off work, how long symptoms last and the other driver's policy limit. Fault is usually clearer, which tends to help.

What is the average settlement for a car accident with a lawyer?

No official data compares settlements with and without lawyers. Claims with lawyers tend to be the larger, more serious ones, so averages mix cause and effect. A lawyer's fee, often one-third, comes out of the recovery.

How long does it take to get a settlement?

Simple claims with finished treatment can settle within a few months. Most insurers will not make a serious offer until treatment ends and the bills are in. Claims that go to a lawsuit commonly take a year or more.
