If you were partly at fault

Idaho follows modified comparative negligence, 50% bar. Your damages are reduced by your percentage of fault, and you recover nothing if you were at least as much at fault as the other side (50% or more).

  • With $100,000 in damages and 30% of the fault, you would recover $70,000.
  • With 55% of the fault, you would recover $0, because the rule bars your claim.

Plaintiff barred at 50% (fault must be less than the defendant's). Damages diminished by plaintiff's share. Idaho compares plaintiff against each defendant individually under case law.

At-fault (tort) state

In Idaho the driver who caused the crash is responsible for the damage, so you claim against their liability insurance or sue them. Your own medical payments or health coverage can pay bills while the claim is pending.

Minimum car insurance in Idaho

$25,000 per person and $50,000 per accident for injuries, $15,000 for property damage. Uninsured motorist coverage is optional or can be rejected in writing.

Many drivers carry only the minimum, so the bodily injury limit is often the most the at-fault driver's insurer will pay one person. UM and UIM must be included at the 49-117 limits, but 'A named insured shall have the right to reject either or both uninsured motorist coverage or underinsured motorist coverage' in writing (41-2502(2)), so not mandatory.

Damage caps

Idaho caps noneconomic damages: Base cap of $250,000 (2003), adjusted every July 1 by the change in the state average annual wage. It does not apply to willful or reckless misconduct or to acts found beyond a reasonable doubt to be a felony. Punitive damages: Greater of $250,000 or 3x compensatory damages (Idaho Code 6-1604(3))

Reckless driving or DUI-type conduct may fall under the willful/reckless or felony exceptions.

Dog bite law

One-bite rule (no strict liability statute). No Idaho statute imposing strict civil liability for dog bites was identified. Idaho Code ch. 25-28 (Dogs) contains running-at-large infractions (25-2805) but not a bite liability rule; liability follows common law (known vicious propensity or negligence).
